“Grading My Boss: A Federal Judge’s Evaluation of the Supreme Court’s Recent Decisions”
In the current term, the Supreme Court has been called upon to decide an unusual number of controversial issues with immediate impact. For example, the Court’s recent decision narrowing the Voting Rights Act of 1965 has already led several states to substantially re-draw the boundaries of their Congressional districts. In this talk, Judge Rakoff examines the strengths and weaknesses of the Court’s reasoning in several such cases, as judged by traditional modes of judicial reasoning.
Jed S. Rakoff has served since March 1996 as a U.S. District Judge for the Southern District of New York. He frequently sits by designation on the 2nd and 9th Circuit Courts of Appeals. His most noteworthy decisions have been in the areas of securities law and criminal law. He is an Adjunct Professor at Columbia Law School and NYU Law School, and also teaches at Berkeley Law School and the University of Virginia Law School. He has written over 200 published articles, 900 speeches, and 2800 judicial opinions, and has co-authored five books. He is a regular contributor to the New York Review of Books, and the author of Why The Innocent Plead Guilty and the Guilty Go Free, and Other Paradoxes of Our Broken Legal System (Farrar Straus & Giroux, 2021).
